Terms and Conditions of Sale

If you do not agree to these terms and conditions, you must cancel your order with us prior to shipping or within 1 business day - whichever is sooner. No restocking fee will be applied to orders canceled within that time frame.


Buyer in the USA certifies that he/she is at least 21 years of age. Buyer will have to certify to this on our secure order server prior to placing an order. Further certification may be required at time of delivery. The billing address needs to be the address on your credit card statement. Your billing address is where your order will be shipped. If you wish to ship to an address different from your billing address, please provide this information on your order form.

Orders unpaid 7 days after being placed will be canceled.


In the United States, alcohol shipping laws continually change. If at the time of delivery, we are unable to legally deliver wine to you, we will cancel your order and refund 100% of your payment if an alternative may not be found. It is in our sole discretion whether we can legally ship you wine.

We always recommend shipping to a business address where someone will be present to receive it during business hours. All shipping carriers require an adult signature at the time of delivery. Signature releases are not accepted. If the shipment is returned to us for an improper or incomplete address we will have to re-charge you for re-shipment, so please make sure the address is complete including business name, department or mail stop, if any, and suite number if going to a business complex.

Buyer is responsible for shipping charges.  Shipping will be invoiced separately from your wine purchase and wine will be shipped once we receive payment for shipping charges.

By submitting an order to the Top Tier Wines (www.toptierwines.com) website you are stating that you are 21 years old or older, and warrant that you are legally able to purchase and consume alcoholic beverages at your place of delivery.   

We make no representation to the legal rights and ability of anyone to ship or import wines into any state outside of Washington or any country outside the USA. YOU, the buyer, are solely responsible for shipment of alcoholic beverage products. By placing an order for delivery in the USA, you authorize us to act on your behalf to engage a common carrier to deliver your order to you.


When your alcoholic beverages are delivered, the person receiving delivery will be required to show identification proving that he or she is at least 21 years old. If any person under 21 years of age fraudulently orders and has wine shipped to them, the wine will not be released to them, and will be returned to us, and the cost of return shipping will be charged to the responsible party.


If you change your order after it is prepared for shipping, we reserve the right to charge for additional handling and packaging materials.

Availability and Pricing

Prices and availability are subject to change without notice. Due to variations in condition and sourcing, different bottles of the same wine may occasionally be posted with different prices. Due to the real time nature of our website, items are not removed from our inventory until after successful 'check out'. Invoices, verbal and email confirmation notwithstanding, no item is guaranteed to be available until it has been pulled for shipping.

Pre-Arrival Sales

Top Tier Wines sells some wines on a pre-arrival basis. Payment for these wines is due at the time of invoicing. Upon arrival of these wines to our warehouse you will be contacted to arrange final delivery to you. 

For pre-arrivals sales, delivery dates are never certain and due to circumstances beyond our control arrival dates may change. 

For a variety of reasons, some wines ordered on a pre-arrival basis may not, ultimately, be available to us. When we are notified we are not able to obtain a wine, we will refund your full payment to you. We will not be liable for incremental or consequential damages, or be required to source a replacement.

Shipping Conditions

Top Tier Wines ships via common carrier. Orders generally leave between four to seven days after the order is placed unless an item is sold on a pre-arrival basis.

Top Tier Wines reserves the right to hold shipment of your wine during extreme weather conditions. Top Tier Wines cannot be responsible for damage to wine (including leakage or damaged corks) shipped to you against our advice in regards to weather conditions. Please be aware of the scheduled delivery information, as the date, and location of your delivery cannot be changed once it leaves our warehouse. It is your responsibility to be present when your shipment arrives. If the weather is very hot or cold in your area, and you would like us to postpone our shipping, please advise us. Use the weather in your area as a guide, when making your choice for best shipping method. We do not advise shipping via ground during temperatures over 80°F or under 32°F. We do not advise shipping during temperatures over 90°F. If you need your order by a specific date, please let us know and we will work with you to try to get the wine to you in time for your needs.

Top Tier Wines cannot be responsible for wine damaged by a shipper or inappropriate storage/handling on the part of the shipper. We reserve the right to refuse sales if we deem it to be inappropriate and/or unsafe.

We cannot ship to PO, APO, or FPO box offices. Incorrect, insufficient or change of address will incur a $10.00 surcharge. We reserve the right to charge return shipping for refused or undelivered packages. Please allow up to 2 business days for your order to be processed.

Wine cannot be shipped via the United States Postal Service. If wine is not accepted after two delivery attempts, Top Tier Wines reserves the right to invalidate its quality guarantee as repeated delivery attempts may subject the wine to undue temperature stress.

Holding Wines

Top Tier Wines will hold customer orders for up to 30 days before shipping or until the next seasonally moderate shipping window. This service is provided at no charge as a courtesy for our customers. Wine so held remains the property of the buyer. Customers who choose not to ship within 30 days of order during a seasonally moderate shipping window may incur an additional charge for this service until shipment of the order. Top Tier Wines reserves the right to move wine to an alternate storage facility and/or to charge additional fees for the storage of especially large orders over long periods of time.

International Orders

We cannot accept international orders at this time.

Errors, Omissions and Availability

Occasionally, our inventory, quantity available, listed prices, or bottle sizes may be incorrect. For example, a 750ml size may be incorrectly priced as a 375ml bottle. Sometimes for matters beyond our control, items sold on a pre-arrival basis may turn out to be unavailable. When such situations occur, Top Tier Wines shall be held harmless for the error. We make every effort to make sure that our product database is accurate, however mistakes do happen. In all cases, the customer will be contacted as soon as the problem is discovered. We will promptly return to the customer any money collected upon discovery of the problem. A refund will be the limit of the remedy.

Returns and Cancellations

All requests for cancellations must be made within 14 days of the sales order date, no exceptions. Once an order has shipped cancellation is not possible.  Because of the fees charged by your credit card company when we charge and subsequently credit your card, we will enforce the collection of a restocking fee if your card has already been charged (usually the evening of the same day). If we haven't charged your credit card, you may cancel the order without being subject to a restocking fee. If we have already charged your card, the cancelled processed credit card order for all items - in-stock or prearrivals- shipped or not, are subject to a 15% restocking fee. Please check your order receipt carefully to make sure you ordered the correct wine. We will not be responsible for any incorrect orders placed by you, the customer. Any incorrect orders that are processed and shipped will be subject to a 15% restocking fee, as well as shipping charges back to us if you want to return the item(s). The prices for wine can fluctuate greatly from day to day, because of this we do not accept returns for wines based on price changes within the marketplace.

Damaged goods

We ship using carrier compliant packing materials specifically designed for wine. If there is an issue send us images to info@toptierwines.com and we will work with you and the carrier to resolve it quickly.

Sales Tax

Top Tier Wines is required to collect and remit sales tax in various jurisdictions. If required, your order will include the legally required sales tax of your jurisdiction.

Disclaimer of Warranties and Limitation of Liability

This site is provided on an "as-is" and "as available" basis. No representations or warranties of any kind are made, express or implied, as to the operation of this site or the information, content, materials or products included on this site. You expressly agree that your use of this site is at your sole risk.

To the full extent permissible by applicable law, this site's owner disclaims all warranties, express of implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. This site's owner does not warrant that this site, its servers, or emails sent from this site are free of viruses or other harmful components. This site's owner will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive and consequential damages.

Certain state laws do not allow limitations or implied warranties or the exclusion of limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions or limitations may not apply to you, and you might have additional rights.


Our Guarantee

Top Tier Wines guarantees quality products and service.  Top Tier Wines guarantees that wine is in excellent condition, or the condition that is stated in its offer, at time of delivery if it is shipped by the method recommended by Top Tier Wines, within the laws of the state into which it is shipped and is accepted on the first delivery attempt.

Your satisfaction is our first priority. If, for any reason, you are dissatisfied with your order, please contact us within 14 days of the date of your order for customer care assistance. For fastest results, contact us by emailing info@toptierwines.com.  Top Tier Wines cannot accept return of any bottle of wine that has been opened or altered nor any bottle of wine that has been out of its possession for more than two months.

All bottles 10 years or older are purchased at the buyer's risk, and we cannot be responsible for "corked" bottles. BUT if you're not happy with a purchase, please contact us so we can work out an agreeable resolution.

  • All wine sold by us is maintained at optimum conditions. We consider wine to be out of our control once it has been handed over to the shipper and we cannot be responsible for improper storage after it has been delivered, and as such we cannot accept returns for the following:
    • Wines that do not coincide with personal tastes.
    • Wines that have been adversely affected by customer's storage.
    • Any other adverse condition affected while in customer's care.
    • You must be 21 and over to purchase and consume wine and alcohol. By using this website, you agree to be bound by the terms and conditions above.
